RJ DRIVE AB – TERMS & CONDITIONS OF SERVICE

These Terms & Conditions govern all services provided by RJ Drive AB. By signing this Agreement, confirming a booking, or paying a deposit, the Customer and/or Owner ("the Customer") acknowledges that they have read, understood, and agreed to be bound by these Terms & Conditions.

1. Definitions & Scope of Services

Throughout this Agreement, the following definitions apply:

  • "Chauffeur Services" means services where RJ Drive AB supplies only a professional driver to operate a vehicle provided by the Customer. For Chauffeur Services, the Customer remains solely responsible for the transport operation, the vehicle, and compliance with all applicable transport legislation, licences, permits, and documentation. RJ Drive AB provides professional driving services only.

  • "Carrier Services" means transport services performed using a vehicle owned or operated by RJ Drive AB.

These Terms apply to all transport services, including commercial carriage under Carrier Services, as well as independent driving operations under Chauffeur Services.

2. Carrier Liability – Live Animals (CMR Convention)

This section applies strictly to Carrier Services. Where applicable, the international carriage of goods by road shall be governed by the Convention on the Contract for the International Carriage of Goods by Road (CMR).

The Customer acknowledges that the transport of live animals involves inherent risks arising from their nature, behaviour, temperament, stress, movement, illness, or reactions during transit.

To the fullest extent permitted by applicable law, including Chapter IV, Article 17(4)(f) of the CMR Convention, RJ Drive AB shall not be liable for injury, illness, death, escape, or loss resulting from the special risks inherent in the carriage of live animals unless such loss has been caused by the proven intentional misconduct or gross negligence of RJ Drive AB where liability cannot legally be excluded.

3. Owner's Responsibility Before Transport

The Customer warrants that:

  • Every horse is fit for transport;

  • All required veterinary documentation, passports, health certificates, and permits are valid and up to date;

  • Horses are correctly identified;

  • Horses are safe to load and transport;

  • Any known behavioural issues, medical conditions, or special requirements have been fully disclosed in writing before departure.

RJ Drive AB reserves the absolute right to refuse transport where an animal appears unfit for travel or where documentation is incomplete.

4. Groom or Travelling Attendant

Where a groom, owner, rider, or authorised representative accompanies the transport, that individual remains solely responsible for:

  • Feeding and watering;

  • Monitoring health and physical condition;

  • Administering any required medication;

  • Handling the horse during stops;

  • Supervising the horse's safety inside the vehicle during transit.

RJ Drive AB is contracted solely to provide transportation driving services and shall not be responsible for any failure by the accompanying attendant to properly care for the horse.

5. Customer-Owned Vehicle Warranties

For Chauffeur Services, the Customer warrants that the vehicle:

  • Is fully roadworthy and mechanically suitable for the intended journey;

  • Has valid registration, road tax, and official technical inspection (Besiktning);

  • Complies with all applicable transport legislation and axle weight limitations;

  • Possesses a legally functioning, calibrated, and compliant Tachograph system;

  • May legally be driven in every country forming part of the journey.

Mandatory Documentation Provision: The Customer must provide the driver with—or digitally forward well in advance of departure—the vehicle's registration documents, valid insurance proof, and an official Letter of Authorization / Power of Attorney on company letterhead confirming that RJ Drive AB is authorized to operate the vehicle. For cross-border transits, the Customer must ensure that all customs clearances, own-account transport declarations, or electronic transit logs are either physically present in the cab or fully accessible in a valid digital format (such as a PDF or official QR code) on the driver's device before the wheels turn

RJ Drive AB accepts no responsibility or financial liability for fines, road penalties, operational delays, breakdowns, or structural losses arising from vehicle defects, lack of maintenance, missing vehicle documentation, missing authorization letters, overloaded weight limits, or non-compliance with tachograph regulations. Any associated costs, including roadside recovery or legal fines, remain the sole responsibility of the Customer.

6. Vehicle Condition & Liability Exclusions

Acceptance of vehicle keys or the physical operation of the Customer's vehicle under Chauffeur Services does not constitute an inspection, certification, warranty, or acceptance of its mechanical fitness.

Except where liability cannot legally be excluded, RJ Drive AB shall not be liable for:

  • Pre-existing structural, cosmetic, or mechanical damage;

  • Hidden or latent mechanical defects;

  • Ordinary mechanical wear and tear;

  • Failures arising from the vehicle's underlying mechanical condition.

The Customer is solely responsible for inspecting and documenting the vehicle's condition before the journey begins.

7. Fuel, Operating Costs & Journey Preparation

The Customer shall ensure that any supplied vehicle contains sufficient fuel, AdBlue, engine oil, coolant, and washer fluid. Any fuel top-ups, road tolls, parking charges, ferry bookings, emergency roadside assistance, or other necessary operating expenses paid out of pocket by RJ Drive AB during transport shall be fully reimbursed by the Customer.

For horse transport, the Customer is responsible for preparing the horse for travel, including the discretionary use of rugs, travel boots, or protective equipment, which remain entirely at the Customer's own risk.

8. Insurance

The Customer is personally and legally responsible for maintaining appropriate, comprehensive insurance covering the horses, vehicles, trailers, cargo, and comprehensive third-party liability. Except where liability cannot legally be excluded by law, RJ Drive AB shall not be liable for losses or damages that should reasonably be covered by the Customer's own insurance policies.

The Customer acknowledges that RJ Drive AB's insurance may not cover losses arising from defects, insufficient insurance, or unlawful operation of Customer-provided vehicles.

9. Safety & Emergency Decisions

RJ Drive AB reserves the absolute right to refuse loading, suspend transport, terminate transit, or unload a horse at a suitable location where, in the opinion of the driver, continued transport would endanger the horse, other animals, transport staff, members of the public, or the vehicle. The driver's reasonable decision made in the interests of safety shall be final.

Where immediate veterinary attention is required and the Customer cannot be contacted in a timely manner, RJ Drive AB is authorized to seek emergency veterinary care on the Customer's behalf. All veterinary fees, emergency treatment costs, recovery charges, and alternative stabling costs remain fully payable by the Customer.

10. Force Majeure & Border Delays

RJ Drive AB shall not be held liable for transport delays, schedule disruptions, or financial losses resulting from circumstances beyond its reasonable control, including but not limited to: severe weather, traffic accidents, road closures, ferry cancellations, border inspections, customs audits, disease outbreaks, veterinary restrictions, or technical delays regarding digital health certificate networks (such as TRACES NT). Additional expenses arising from such administrative or environmental delays shall be borne solely by the Customer.

11. Customer Regulatory Compliance

For Chauffeur Services, the Customer remains solely responsible for ensuring complete compliance with all applicable regional, national, and international transport legislation, including but not limited to:

  • Operator licences and Community licences;

  • Own-account transport rules and cabotage restrictions;

  • Driver authorisations and vehicle taxation;

  • Customs documentation, permits, and comprehensive insurance;

  • Veterinary documentation, horse passports, and transit logs.

RJ Drive AB shall not be liable for any penalty, prohibition, roadside delay, vehicle impoundment, or enforcement action resulting from the Customer's failure to comply with applicable legislation.

12. Photographs & Documentation

RJ Drive AB reserves the right to photograph or film horses, vehicles, trailers, and cargo before, during, or after transport for documentation, safety checks, insurance validation, and evidential purposes. Such media may be securely retained for legal, contractual, and insurance purposes.

Social Media Provision: RJ Drive AB may additionally use select, promotional-quality photographs or video footage of vehicles, transport environments, or horses for marketing and social media purposes. RJ Drive AB guarantees that no sensitive personal data, private residential addresses, or identifying client financial details will be visible. The Customer may explicitly opt out of this social media usage at the time of booking by notifying RJ Drive AB in writing.

13. Data Protection

RJ Drive AB processes personal data solely for booking management, transport logistics, invoicing, legal compliance, and customer service purposes in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

14. Governing Law & Jurisdiction

This Agreement, and all operational services rendered thereunder, shall be governed by and construed exclusively in accordance with the laws of Sweden.

For all Chauffeur Services, the Customer explicitly agrees that any dispute, claim, or legal proceeding arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the Swedish courts (with the Uppsala District Court / Uppsala tingsrätt as the court of first instance).

For Carrier Services, any dispute shall similarly be brought exclusively before the Swedish courts, except where mandatory international treaties (such as the CMR Convention) strictly and non-negotiably grant jurisdiction to another nation's courts.

15. Entire Agreement & Severability

These Terms & Conditions constitute the entire legal agreement between RJ Drive AB and the Customer and supersede any previous verbal promises, text messages, or written agreements relating to the services. If any specific provision within this document is held to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.
